This is the “Inter se seniority” rule. The Marathi version is crystal clear: जर थेट उमेदवार आणि पदोन्नती उमेदवार एकाच वर्षात रिक्त जागेवर आले, तर ज्येष्ठता प्रति-प्रमाणात (roster / quota) ठरवली जाईल. In simple terms: If a direct recruit and a promote join in the same year based on the same recruitment year’s vacancies, they share seniority in the ratio of the quota (e.g., 50:50), not by their individual joining dates.
These rules were created using the powers conferred by the proviso to Article 309 of the Constitution of India.
